These Terms of Service (the "Terms") govern your access to and use of the SleepTight website, online store, products, subscriptions, and related services (collectively, the "Services"). The Services are operated by ST Wellness LLC under the SleepTight brand ("SleepTight," "we," "us," or "our"). By visiting the website, placing an order, starting a subscription, submitting content, or otherwise using the Services, you agree to these Terms and any policies or terms referenced in them.

1. Acceptance of These Terms

Please read these Terms carefully before using the Services. If you do not agree to these Terms, you may not use the Services. Additional terms presented during a purchase, subscription enrollment, promotion, or use of a particular feature also apply. If those additional terms conflict with these Terms, the more specific terms control for that feature or transaction, to the extent permitted by law.

2. Eligibility and Online Store Use

You must be at least the age of majority in your place of residence and have the legal capacity to enter into a binding agreement to make a purchase or start a subscription. You may use the Services only for lawful purposes and in accordance with these Terms. You are responsible for ensuring that your use of the Services and any product you purchase complies with laws that apply to you.

3. Products and Availability

SleepTight is a dietary supplement sold as individual purchases and, where offered, through recurring subscription plans. Products, package sizes, flavors, purchase options, promotions, and availability may change without notice. We may limit quantities, discontinue products, or decline sales when reasonably necessary, including to address inventory limitations, suspected fraud, misuse, or legal requirements. Products are intended for personal use and may not be purchased for unauthorized resale.

4. Dietary Supplement and Medical Disclaimer

SleepTight is a dietary supplement. Information provided through the Services is for general informational purposes only and is not medical advice. SleepTight products and statements about them are not intended to diagnose, treat, cure, or prevent any disease. The Services are not a substitute for advice, diagnosis, or treatment from a qualified healthcare professional. Individual responses to dietary supplements vary, and no particular result is guaranteed.

5. Safety and Proper Use

Always read and follow the product label, directions, warnings, serving information, and storage instructions. Do not use a product if its packaging appears opened, damaged, or tampered with. If you are pregnant or nursing, take medication, have a medical condition, or have questions or concerns about whether a product is appropriate for you, consult a qualified healthcare professional before use. Discontinue use and seek appropriate medical guidance if you experience an unexpected reaction. For a medical emergency, contact emergency services or seek immediate medical care.

6. Product Information

We work to present product descriptions, ingredient information, packaging, images, colors, weights, and other details accurately. Minor differences may occur because of display settings, packaging updates, production changes, or other factors. The product label and packaging received with your order contain the most current directions, warnings, ingredients, and product-specific information and should be reviewed before use. If you notice a material discrepancy, contact us before using the product.

7. Orders and Acceptance

Your order is an offer to purchase. An order confirmation acknowledges receipt but does not necessarily mean we have accepted the order. We may verify information before accepting or fulfilling an order. We may reject, limit, or cancel an order for legitimate reasons, including product unavailability, pricing or listing errors, suspected fraud, unauthorized resale, payment issues, or legal restrictions. If we cancel an order after payment has been collected, we will return the applicable amount to the original payment method, subject to normal processing times.

8. Pricing, Taxes, and Payment

Prices are shown in the currency displayed at checkout and may change without notice. Applicable taxes, shipping charges, and other disclosed fees may be added at checkout. By providing a payment method, you represent that you are authorized to use it and authorize us and our payment processors to charge all amounts shown for your order or subscription. Payment processing is provided by Shopify and other third-party providers and may be subject to their terms and privacy practices.

9. Subscriptions

If you select a subscription purchase option, your subscription will automatically renew at the delivery interval shown when you enroll until you cancel it. You authorize recurring charges to your selected payment method for each renewal order. The recurring amount may include the product price, applicable taxes, shipping charges, and other amounts disclosed for the plan. Pricing or other subscription terms may change only as permitted by law and with any notice required by law.

You may manage the options available for your subscription through your Shopify customer account or the subscription management link provided to you. Canceling a subscription stops future subscription renewals and charges, but it does not automatically cancel, refund, or reverse an order that has already been processed or fulfilled. Any separate Shopify Subscription Policy, purchase-options cancellation terms, or subscription terms presented when you enroll also apply. Nothing in these Terms limits cancellation or other rights that cannot be waived under applicable law.

10. Shipping and Delivery

Shipping estimates are estimates and are not guaranteed unless we expressly state otherwise. Delivery timing may be affected by carriers, weather, address issues, demand, and other circumstances outside our reasonable control. You are responsible for providing a complete and accurate shipping address and for reviewing it before submitting an order. Title and risk of loss transfer as provided by applicable law and the carrier's terms. For information about a delayed, missing, damaged, or misdelivered order, contact us with your order number.

11. Returns, Refunds, Replacements, and Order Issues

Returns, refunds, replacements, damaged shipments, incorrect orders, and other order issues are handled under our current Refund Policy. That policy is the authoritative source for eligibility requirements, request timelines, exclusions, and available resolutions. Nothing in these Terms creates an additional return or refund right beyond the Refund Policy or rights provided by applicable law. Contact us promptly if an order arrives damaged, leaking, opened, defective, or incorrect, and retain the product and shipping packaging while your request is reviewed.

12. Customer Accounts

Some features may use a Shopify customer account or email verification. You are responsible for providing accurate account information, maintaining the security of your login or verification access, and promptly updating information that changes. You are responsible for activity conducted through your account unless caused by our failure to use reasonable security measures. Notify us promptly if you believe your account or order information has been accessed without authorization.

13. Reviews and Other User Content

If you submit a review, photo, feedback, question, or other content ("User Content"), it must reflect your genuine experience and must not be unlawful, fraudulent, abusive, defamatory, misleading, infringing, spam, or a violation of another person's privacy or rights. You retain ownership of your User Content.

By submitting User Content, you grant ST Wellness LLC a nonexclusive, worldwide, royalty-free license to host, reproduce, format, display, distribute, and use that content in connection with operating, improving, and promoting SleepTight and the Services. You represent that you have the rights needed to grant this license. We may moderate, reject, or remove User Content that violates these Terms, applicable law, or the rights of others. We do not remove a review merely because it expresses a genuine unfavorable opinion.

14. Intellectual Property

The SleepTight name, brand elements, logos, website copy, graphics, photography, packaging artwork, design, layout, and other original creative assets owned by ST Wellness LLC are protected by intellectual property laws. Except for the limited right to use the Services for their intended purpose, no rights are transferred to you. You may not copy, reproduce, modify, distribute, sell, exploit, or create derivative works from our protected materials without prior written permission.

Shopify technology, third-party trademarks, and third-party content remain the property of their respective owners. User Content remains owned by its creator, subject only to the limited license described in these Terms.

15. Prohibited Uses

You may not use the Services to violate law; infringe intellectual property, privacy, publicity, or other rights; submit false, deceptive, or harmful content; introduce malware or disruptive code; scrape or harvest data without authorization; interfere with security or operation; impersonate another person; make fraudulent purchases; misuse promotions; engage in unauthorized resale; or attempt to gain unauthorized access to any account, system, or data. We may investigate suspected misuse and cooperate with lawful requests from authorities.

16. Third-Party Services and Links

The Services may rely on or link to third-party services, including Shopify, payment processors, carriers, subscription tools, and external websites. Those services are operated independently and may have their own terms and privacy practices. We are not responsible for third-party content, availability, security, products, or conduct, except to the extent responsibility cannot be excluded by law. A link or integration does not necessarily mean we endorse every statement, product, or service offered by that third party.

17. Errors, Inaccuracies, and Omissions

Information on the Services may occasionally contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, offers, shipping charges, delivery estimates, or availability. We may correct errors, update information, or cancel affected orders when reasonably necessary. If an error affects an order you have already paid for and we cancel that order, we will return the applicable amount to the original payment method.

18. Disclaimer of Warranties

To the fullest extent permitted by law, the Services and products are provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and noninfringement. We do not warrant that the Services will always be uninterrupted, secure, or error-free, or that a product will produce a particular result for every person.

Some jurisdictions do not allow certain warranty exclusions. In those jurisdictions, the exclusions apply only to the extent allowed by law. Nothing in these Terms excludes any warranty, guarantee, or consumer right that cannot lawfully be excluded.

19. Limitation of Liability

To the fullest extent permitted by law, ST Wellness LLC and its members, managers, employees, agents, contractors, service providers, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, or business opportunities, arising from or related to the Services, products, or these Terms, even if advised that such damages may occur.

To the fullest extent permitted by law, the total liability of ST Wellness LLC for a claim arising from a product, order, subscription, or use of the Services will not exceed the amount you paid to ST Wellness LLC for the specific product, order, or subscription giving rise to the claim. These limits do not apply to liability that cannot lawfully be limited or excluded, including rights available under applicable consumer protection law.

20. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless ST Wellness LLC and its members, managers, employees, agents, contractors, service providers, and affiliates from third-party claims, losses, liabilities, damages, and reasonable costs arising from your unlawful misuse of the Services, your material breach of these Terms, or User Content that infringes another person's rights. This obligation does not apply to the extent a claim results from the conduct of ST Wellness LLC or where indemnification is prohibited by law.

21. Severability

If any provision of these Terms is found unlawful, void, or unenforceable, that provision will be enforced to the maximum extent permitted and the remaining provisions will remain in effect. If possible, an unenforceable provision will be interpreted to best accomplish its intended lawful purpose.

22. Suspension and Termination

You may stop using the Services at any time. We may suspend or terminate access to the Services if you materially violate these Terms, create security or legal risk, engage in fraud or abuse, or use the Services in a way that could harm us, customers, or third parties. Provisions that by their nature should survive termination, including payment obligations, intellectual property rights, disclaimers, liability limits, indemnification, and dispute-related provisions, will survive.

23. Changes to These Terms

We may update these Terms to reflect changes in the Services, our practices, legal requirements, or other legitimate business needs. Updated Terms will be posted on this page. When required by law, we will provide additional notice or obtain consent. Changes apply prospectively from the date they become effective and do not alter rights or obligations that arose before that date unless permitted by law.

24. Governing Law

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-laws principles, except where the mandatory laws of your place of residence apply. Any dispute must be brought in a court with lawful jurisdiction, and nothing in these Terms limits rights you may have to bring a claim in another forum under applicable consumer law.
